Commonwealth v. Daniel Justin Rose; Two Life Terms in Prison for Sexual Assault on Young Child

Virginia Beach, Va. – Colin D. Stolle, Commonwealth's Attorney for the city of Virginia Beach, announced that Daniel Justin Rose, 36 years old, formerly of the 900 block of Virginia Beach Boulevard in Virginia Beach, Virginia, was sentenced for charges of Forcible Sodomy – Victim Under Age 13, Object Sexual Penetration – Victim Under Age 13, Aggravated Sexual Battery, and Custodial Indecent Liberties. Rose was found guilty by a jury after a multi-day trial which began on December 5, 2022. Circuit Court Judge Stephen C. Mahan, who presided over the trial, sentenced Rose to two (2) terms of life in prison plus 25 years, with 25 years suspended, leaving two (2) terms of life in prison to serve.

The Commonwealth's evidence proved that on March 15, 2021, Daniel Justin Rose sexually assaulted a young child who was left in his care at the Colony Trailer Park in Virginia Beach. The child reported the incident to a relative immediately upon the relative's return. The child had a Sexual Assault Nurse Examination (S.A.N.E.) the next day and described the sexual abuse to the S.A.N.E. nurse. Rose admitted watching the children but denied the abuse.

Rose has no prior criminal history; however, is alleged to have abused at least one other minor victim, who testified against Rose at his sentencing hearing in Circuit Court today.
