Commonwealth v. Davian Isaiah Wallace; Drunk Driver Sentenced to 8 Years, 24 Months for Wrong-Way I-264 Crash

Virginia Beach, Va. – Colin D. Stolle, Commonwealth’s Attorney for the city of Virginia Beach, announced that Davian Isaiah Wallace, age 27, formerly of the 2200 block of Tattewhall Lane in Chesapeake, Virginia, was sentenced for charges of DUI – Reckless – Victim Permanently Impaired (2 counts), DUI – Reckless Disregard – Victim Serious Injury, DUI, and Driving on Suspended License.  Circuit Court Judge Salvatore Iaquinto sentenced Wallace to 25 years and 24 months with seventeen (17) years suspended, leaving eight (8) years and 24 months to serve.  This sentence was significantly higher than the Virginia State Sentencing Guidelines’ recommendation of no more than three (3) years and five (5) months.

Wallace pled guilty on June 25, 2025.  Had this matter gone to trial, the Commonwealth’s evidence would have proven that on September 27, 2024, Wallace drove his vehicle onto the offramp for Interstate 264-W and began to drive in the wrong direction on I-264. A vehicle driven by J.L., with passenger I.V., was traveling in correct direction of travel on I-264-W.  Wallace hit the oncoming vehicle head-on.  Both J.L. and I.V. were seriously injured in the crash and required significant medical treatment.  J.L. suffered a broken left arm, broken ribs, a broken neck, a broken hip, a broken jaw, lost his spleen, and has several scars.  I.V. had a severe concussion and several broken and chipped teeth that required implants and root canals.

The crash caused the victims’ vehicle to hit several other vehicles, including one driven by K.C.  K.C. suffered a concussion, post-concussion syndrome, cognitive communication deficit, a strain of neck muscles, and a strain of the lumbar region. 

An officer with the Virginia Beach Police Department arrived on scene and noticed an odor of alcohol on Wallace.  His blood was obtained from the hospital and was determined to have a serum BAC of 0.224%, which is equivalent to a whole blood BAC of 0.189%.  His driver’s license was suspended at the time of the crash. 

Wallace has prior convictions for Speeding – 20 m.p.h. over, Speeding, and Reckless Speeding.
