Commonwealth v. Erwin Marroquin Herrera ; 15 Years to Serve for DUI Crash that Killed One, Injured Another

Virginia Beach, Va. – Colin D. Stolle, Commonwealth’s Attorney for the city of Virginia Beach, announced that Erwin Marroquin Herrera, age 26, was sentenced today on charges of Aggravated Involuntary Manslaughter and DUI – Maiming. Circuit Court Judge James C. Lewis sentenced Marroquin Herrera to 25 years in prison with ten (10) years suspended, leaving fifteen (15) years to serve.  This sentence was above the high-end of the Virginia State Sentencing Guidelines which recommended a sentence no greater than eight (8) years and three (3) months. 

Marroquin Herrera pled guilty on August 19, 2026. Had this matter gone to trial, the Commonwealth’s evidence would have proven that on August 23, 2025, at about 2:20 a.m., 37-year-old Steven A. White II had finished a Door Dash delivery to the Strawbridge section of Virginia Beach and was returning home in his 2022 Kia Soul. He drove northbound on London Bridge Road in the direction of the I-264 on-ramp.  At the same time, Marroquin Herrera drove his Toyota 4-Runner southbound on London Bridge Road. Marroquin Herrera struck White’s vehicle head-on.  White’s vehicle was crushed by Marroquin Herrera’s larger 4-Runner and was pushed back, coming to a final rest on the sidewalk.  Marroquin Herrera’s vehicle entered the median sideways, struck a tree on the driver’s side, and caught fire.

A civilian driving upon the scene saw a cloud of smoke as the vehicles collided, and he stopped to help.  He first attempted to help the victim, but there were no signs of life. As he turned his attention to the 4-Runner, he saw Marroquin Herrera climbing out and carried him to the sidewalk. Although the vehicle was engulfed in flames, the civilian saw additional movement inside. As the passenger of that vehicle began to climb from the vehicle, the civilian helped him out and carried him to the sidewalk. 

Police and rescue personnel responded to the scene.  White was pronounced deceased at the scene.  Marroquin Herrera and his passenger were transported to the hospital.  His passenger suffered serious injuries which required surgery but survived the crash.  Marroquin Herrera’s blood was drawn by hospital staff and sent to the Virginia Department of Forensic Science. A toxicologist determined his Blood Alcohol Content was 0.255, which is over three times the legal limit.
