Commonwealth v. Jacarie Harry Wynn; Home Invasion Robbery of Fellow Navy Sailor Draws 10 Years to Serve

Virginia Beach, Va. – Colin D. Stolle, Commonwealth's Attorney for the city of Virginia Beach, announced that Jacarie Harry Wynn, age 22, was sentenced today by Circuit Court Judge James C. Lewis for charges of Robbery (3 counts), Statutory Armed Burglary, and Use of a Firearm. Judge Lewis sentenced Wynn to 53 years in prison with 43 years suspended, leaving ten (10) years to serve.

Wynn pled guilty on July 27, 2021. Had this matter gone to trial, the Commonwealth's evidence would have proven that on August 15, 2020, the victim agreed to buy marijuana from Wynn after seeing a social media post from Wynn. Wynn and the victim knew each other from serving in the Navy together. Seven people were in the victim's apartment when he and Wynn agreed to meet there to complete the transaction. When Wynn and another unidentified individual arrived at the victim's apartment, the victim came outside and agreed to use the iPhone Apple Pay payment application in exchange for the marijuana.

Once the victim returned inside, Wynn contacted him and said that the transaction was unsuccessful. The victim went back outside, and Wynn and his co-conspirator drew a handgun and pointed it at the victim. As the victim, Wynn, and co-conspirator went back into the apartment, Wynn pistol-whipped the victim in the back of the head. Wynn pointed the weapon around the room at the other people inside, holding them at gunpoint. He also pistol-whipped another victim in the head.

Wynn demanded the victims turn over their phones and other belongings. Ultimately, he stole four (4) cell phones and one (1) wallet. With the victim's stolen phone, Wynn tried to transfer money from the victim's account into his own. Wynn and his co-conspirator left, then returned briefly, demanding a cell phone. At this point the victims hid in the back bedroom.

The victim and his friends called police, who arrived on scene shortly thereafter. Two of the victims' stolen cell phones were recovered after being tracked through the "Find My iPhone" app. The victim knew Wynn's first name and provided it to a detective with the Virginia Beach Police Department. The detective searched databases and identified Jacarie Wynn as a potential suspect. The victim identified Wynn in a photo line-up a few days later.

On August 25, 2020, police tracked Wynn to an apartment in Norfolk. He was arrested after jumping off a second story balcony and attempting to flee.
